Client was charged with being an accessory after the fact. The underlying
case to which he was an accessory for consisted of two defendants charged
with four attempted murders. It took about 16 months of work and negotiations
but we were able to settle the case without our client having to go to prison.
Assault with Great Bodily Injury
Assault & Battery
Client was facing over 20 years in prison for assault causing great bodily
injury. Essentially this was a bar fight in Oakley CA with nearly a dozen
people involved. Our client got involved to defend his girlfriend who
was involved in the fight. He was charged with assaulting 2 people; the
main one suffered a broken nose, broken orbital socket, and gash to the
forehead which required stitches.
We went to preliminary hearing on this case. As a result of the work we
put in at prelim and the amazing investigation done by our private investigator
we were able to sit down with the DA and work out a deal for one year
which gets our client out in January 2019. Had he opted not to take that
deal he was facing decades in prison instead of months.
Client was placed in a holding cell (after being arrested for the domestic
violence) in the Concord Police Station and the police were trying to
remove his handcuffs. They didn't like him at all and when he started
to lower his first hand after it was uncuffed and stand up they forced
him into the corner of the cell and pinned him into a wall. There were
one or two officers pushing him into the wall of the cell. The cell he
was in was very small - probably 3 feet by 3 feet. There was somewhat
of a struggle going on. A third officer got involved, entered the small
cell and punched my client square in the face four times as hard as he
could. Then the officer jumped up on top of the small bench in the cell
and elbowed my client on the top of the head as hard as he could. This
caused my client to fall to the ground. They dragged him out of his cell
and then grabbed him by his hair (he had long hair) to drag him to the
ground. He was bleeding profusely from this conduct. He was eventually
taken to the hospital. He suffered many injuries as a result including
a broken orbital socket. He had many different hospital visits and is
still undergoing additional treatment.
At trial we argued that the police officer's conduct was abhorrent
and was a completely inappropriate and excessive use of force. The jury
apparently agreed with me because they delivered a Not Guilty verdict
on this charge (Penal Code Section 148(a)(1)).
DUI case w/ a .13 BAC and an accident getting on the freeway. He is a businessman
who travels a lot for work so has to be able to rent a car. Resolved the
case for a wet & reckless so that his license isn't impacted to
prevent him from renting a car; resolved the case so that he won't
have to put the in-car breathalyzer in his car.
DUI case w/ a .13 BAC. Client was a construction worker; settled case for
non-DUI to save his job.
Domestic Violence Case with Brandishing a Knife and Threatening to Kill
Partner. Case settled for no jail time and no probation.

Drunk in Public & Resisting Arrest - Client was an immigrant and working
in Silicon Valley. Case dropped.
