What Is Assault?
It's a popular misconception that assault entails actual physical violence between two parties. However, in California, assault concerns the threat of violence between the alleged perpetrator and victim (in California, instances of actual physical contact between parties would be considered battery).
According to Penal Code 240 PC, in order for an assault to occur, a person must be aware that their actions are likely to touch another person in an offensive manner or that they are likely to harm them. So, if you are swinging your arms around in a crowded room then you are assaulting the people close enough to get hit.
Penalties for simple assault can include:
- Up to six months in jail
- Up to $1,000 in fines
Thomas Daly has experience handling different types of assault cases and knows what it takes to secure a favorable outcome in the courtroom.
